A Study Of The Transaction Limitation About Rural Land And The Contract Extension

The transaction of rural land is an extremely complex social question.Due to pressures from rural internal and external multiple interests,rural land transaction easily lead to a dispute.But the current rural land transaction problems: rural land requisition of monopoly is not economic and rural "premium" part of the income distribution is not reasonable,severely damage the interests of farmers.This paper uses the literature research to illustrate the history of rural land system from the private to the collective,and analyze the current rural land deals,including the law content,contractual form,earnings and structural defects.According to Williamson' the definition of relational contract,the one-off contract is replaced by the relational contract,that is put forward to solve the problem of land value increment distribution.That is to say,the land monetization compensation way is to improve with the flexibility of relational contract.to make the landless peasant obtain value-added income in certain ratio in order to form a real rural land market price in the progress of the second or third land transaction in the future.Therefore,the way of relational contract can discourage excessively land expropriation,make the landless peasant obtain healthy profits,and increase farmers' incomes from the rural land transaction.Its significance lies in: realize the market values of rural land,shape the true market player in rural land transaction,restrain the land expropriation power of the local governments for excessive reliance on rural land revenue,and increase the value of the rural land and the farmers' income.
