Research About The Labor Rights And Interests Protection Of Informal Employee Of Urban Migrants

Labor rights and interests are the basic needs of workers to participate in labor,whether it is protected and the degree of its protection directly affect the quality of employment of workers,the production performance of employer and the steady development of national society.China is a socialist country,it adheres the concept of people-oriented development,and it always puts the protection of labor rights and interests and the promotion of employment in the key position.However,the protection of labor rights and interests of informal employment of urban migrants is bad,the protection quality should be improved.It is of great value to study the protection of labor rights and interests of informal employment of urban migrants.It is helpful to enhance the quality of employment of informal employment of urban migrants,and it can also promote the social equity and maintain social stability,lastly,and lastly,it is a necessary to build a socialist harmonious society.Based on the theory of human capital,social support theory and incomplete competitive labor market theory,this paper defines the concept of key words and introduces the theoretical connotation.Then it uses the historical analysis method to clarify the development process of the protection of labor rights and interests of informal employment of urban migrants.After that,this paper analyzes the status quo of the protection of labor rights and interests of informal employment of urban migrants in China,points out the main problems of its existence,we find that there are three major causes of these problems,namely,the lack of rights awareness and ability of informal employment of urban migrants,the imbalanced laborrelationship between the informal employment of urban migrants and the employer,the weakness of government ability in protecting the labor rights and interests of informal employment of urban migrants.Based on the results of the protection of labor rights and interests of informal employment of urban migrants in Guangzhou,this paper summarizes the practice of guaranteeing the rights and interests of migrant workers in Guangzhou,and draws the inspiration from the protection of the labor rights and interests of the informal employment of urban migrants in our China,including : The protection of labor rights and interests of informal employment of urban migrants requires multi-participant;the harmony of labor relation is the key of protecting the rights and interests of informal employment of urban migrants;urban integration should be one of the important objectives of protecting the rights and interests of informal employment of urban migrants.In order to promote the protection of rights and interests of informal employment of urban migrants,we should construct a new protection mode which aims at enhancing the rights awareness and ability of informal employment of urban migrants,creating a balanced labor relationship between the informal employment of urban migrants and the employer and enhancing the government ability of protecting the rights and interests of informal employment of urban migrants.What's more,to get this target,the mode needs the multi-participant which includes the government,the labors,the employer and the social organization.In order to achieve the first goal,we should try to enhance the human capital and social support of informal employment of urban migrants;To achieve the second goal,we should construct the self-discipline mechanism and outside-discipline mechanism of the employer;And to achieve the last goal,we should try to enhance the government's supervision andservice capabilities.
