The Compliance Of Minimum Wage In China

The compliance of minimum wage policy is the most ignored and the most important link.If there is no compliance with minimum wage policy,it won't be able to protect low-income worker legitimate rights and interests,safeguard social fairness and justice.Existing literature generally use laborer individual wages compared the minimum wage standard which means the violation of the minimum wage rate to measure the compliance of minimum wage standard.This method exist some shortcomings,it does not distinguish between the distance of different worker pay less than the minimum wage standard,and the size of the distance means that the depth of the minimum wage policy violations.Our paper using Chinese household income projects(CHIP)in 2007 and 2013 data,not only constructs the minimum wage policy violation rate index,also constructs the minimum wage policy violations depth indicator and examines the enterprise the compliance of minimum wage policy and abide by the conditions change.With minimum wage violation rate and depth of indicators,according to the official monthly minimum wage standard and the hour minimum wage standard constructing on the basis of the official monthly minimum wage standard analysis found that:(1)the workers in 2007 violations of minimum wage and hour minimum wage standard rates were 3.91% and 13.64%,the violation of depth are 1.03% and 3.76%;Violations at a rate of 7.32% and 7.32% in 2013,and the depth are 3.21% and 3.21%;(2)the minimum wage growth too fast and laborer average working time falling at different times are the principal causes of the minimum wage policy compliance difference;(3)the laborer's individual characteristics and job characteristics have significant influence on the possibility of suffer from the violation and on the depth while encounter the violation;(4)compared with 2007,the situation of the laborer industry,the enterprise ownership,and household factors leading to low wages have improved.Comprehensive the above conclusions,this paper puts forward the corresponding policy Suggestions:(1)perfect the corresponding laws and regulations,the minimum wage policy in raising the minimum wage standard,also should push for full-time hours minimum wage system at the same time;(2)to strengthen labor laws and regulations of supervision and execution,protect the rights of laborers earn legal wage;(3)strengthen the targeted minimum wage law enforcement inspection,strengthening the low degree,low-skilled workers minimum wages protection.
