Because of the legislation systems of China in the planned economy period,China's agricultural development level is not so high.Along with the pace of urbanization process is accelerated,gradually exposed the shortcomings of collective land expropriation system,China's collective construction land expropriation compensation system and the present stage social development level does not match.Land expropriation behavior are mandatory.The behavior of the government to impose collective land property right problem involves the farmer collective,and property rights are related to farmers' collective personal rights and interests of each and every one of the problems.Is of great significance to protect the legitimate property of citizens are inviolable.China's land requisition compensation is not only the land issues,economic problems,political problems,social problems and legal problems.The unreasonable collective land expropriation system,resulting in waste of land resources,idle phenomenon is serious.Land-lost farmers because of not reasonable compensation can't enjoy the fruits of the development of socialism,conflict with the government,the social atmosphere of tension,all these problems urgently need to China's reform of the collective construction land requisition system as soon as possible.The British land expropriation system can be traced back to the middle of the 19th century,has a long history.Britain has now formed a relatively perfect system of land expropriation system and proposes the concept of land development rights of British industrialization,and promote the urbanization process has played a vital role.Through the analysis of the similarities and difference between Chinese and British land expropriation system,looking for can be used for the Chinese,the collective construction land expropriation compensation mechanism in China is of great significance.The article uses the empirical analysis and comparative analysis method.After the empirical analysis to ask questions,find China land compensation fee and land transfer market price difference is too big.Combing the Sino-British land expropriation compensation mechanism of the market,analysis on the basis of land property rights,land compensation fees as the core,the land value-added income distribution,land tax relief system for the macro control system of form a complete set.Under this system,try to introduce the land development rights concept,analysis the problem of land expropriation market in recent years,as well as the deep-seated reasons for market failure and government failure.Is calculated after the allocation of land development rights to collect the amount of the compensation fees,created based on the land development rights under the path of land expropriation compensation mechanism innovation.Find out the reason of China's land expropriation compensation standard is not reasonable,and how to improve the method.Finally,after the introduction of land right to development new estimation formula for specific empirical analysis,compared with land primary market will once again and put forward the related factors influencing compensation price and transfer the difference,and further puts forward policy Suggestions to perfect China's land expropriation compensation system.
