Land is the essential resource and means of production for human's existence and development. With the transformation from planned economy to market economy in China, the land's potential value is starting to be recognized and identified. lo: is very popular in the world that the government makes are quisition of private property for public interests, which is the radical embodiment of application of the expropriation right. Just on this foundation, Chinese land expropriation system has been founded. Nowadays, however, land expropriation is :more used for the land owned by collective in our country. In other words, when a nation needs using collective land for construction, the land will be expropriated and then belong to the nation. The former possessor and user of the land can get some compensation from the government according to the law. The land expropriation system, which was developed under the planned economy, has exhibited many disadvantages gradually in the market economy. So it is necessary to make a deep discussion and study on this question, analyze its deep reasons, find a viable way to resolve it in current condition, and then improve the land expropriation system in theory and in practice.Based on the summary of the background and current operation state of Chinese land expropriation system, and combined with the theory research, current case study, vivid literal explanation and visual chart, this paper systemically discusses the construction of land expropriation system in China. On the base of adopting foreign experience, analyzing domestic practice, the following new and opinions have been put forward: to consummate land expropriation compensation mechanism, establish collective economy development, to accelerate"pre-market-oriented"of rural land expropriation, and to set up conversion market of collective land for non-agricultural construction.
