| With the further advancement of comprehensive deepening reform,China’s social development lies on the multistage of shifting gears in economy growth,adaptive phase of structural adjustment and digestion of early policies.The transformation of social structure has accelerated,and the pattern of interests has been redivided and adjusted.Under the double pressure of the domestic structural adjustment and the gloomy international economic development,the booming private economy is confronted with a major survival crisis since the reform and opening up,which has made the mass incidents about labor disputes frequent and on the rising.It has became one of the focuses of social contradictions,and seriously affected the realization of labor’s legitimate rights and interests and the social stability.Xiaoshan District,Hangzhou is the leader in economic development in Zhejiang Province,and all economic indicators have always been in the forefront of Zhejiang Province.According to the statistics,the number of the migrant workers in Xioashan District basically is the same as the local residents.These workers are mostly working in manufacturing industry,construction industry,sanitation,housekeeping,catering service and entertainment and other service industry.Because of the specificity of the job and life,there exists some problems.Such as,they may clique in groups easily,they have low cultural qualities,weak ability of dealing with disputes,poor awareness of protecting rights and so on.Therefore,there must be more occurrence of mass incidents about labor disputes.Through field survey research,data statistic,case analysis and so on,the paper combined with the related research results of experts and scholars on labor relations and the case of demanding payments in group in Xiaoshan District,summarized the characteristics and causes of mass incidents of labor disputes in the new period and new situation,studied the corresponding evolution mechanism and governance strategy.The author believed that the main causes of mass incidents of labor disputes were the imperfect system of laws and regulations,the weakening of employee status,the lacking of supervision and administration of government and the way of realizing employee’s rights and interests is not smooth.Therefore,the author focused on the three aspects of legislation,judicature and enterprise system,put forward to improving the labor security system and promoted the collective negotiation in legislative process,split the system of judgement and adjudication and promoted the judicial assistance,advanced the construction of labor unions and the staff psychological relations system,namely the above three aspects of governance strategies. |
