Under the background of three big new eras: "big data,rapid development of Internet technology","the proposal of the "One Belt and one Road strategy concept" and "modification of the Maritime Law," unprecedented changes have taken place in the field of port logistics,in which the bill of lading faces reforms.Especially prominent.Due to the shortcomings of poor security and negotiability of traditional paper bills of lading,the application and development of electronic bills of lading is imperative.This article carefully studies the relevant theory and practice of the application of electronic bill of lading in port logistics,analyzes the legislation practice of electronic bill of lading from three levels: international,foreign,and domestic,and summarizes the latest system application of electronic bill of lading in the entire port logistics practice.From the three core legal relationships in port logistics,the paper analyzes the functional replacement of electronic bills of lading in place of paper bills of lading.The application of electronic bills of lading in port logistics practice,legislative practices,and the function of contract certification,the function of real right certificates,and the function of cargo receipts are summarized to summarise the existence of technical obstacles and legal obstacles,and put forward development thinking in a targeted manner.Comments and suggestions.Starting from the aspects of operational technology and law,on the one hand,the circulation of electronic bills of lading should be “decentralized” and the use of “blockchain” technology to ensure the uniqueness of electronic bills of lading.On the other hand,in this revision of the “Maritime Law”,the legal status of electronic bills of lading should be clarified,and the issue of the power of proof of electronic bills of lading,the issue of control rights,and the rights and obligations of shippers,carriers,and bill of lading holders should be addressed.The legal changes in the four aspects of the institutional issues will be given priority.This will promote the application and development of electronic bill of lading in China's port logistics field.
