An Empirical Analysis Of The Factors Influencing About Patent Holdup From The Perspective Of The Latercomer Enterprises

Now,highly developed Chinese latecomer enterprises in emerging markets are strongly advocating innovation and entrepreneurship,which combines the advantages of the enterprise with its own advantages to obtain the core competitiveness of the competition with the foreign leading enterprises in the market,and improve its own ability,and gradually shorten the gap with the foreign leading enterprises.Based on the model of L&S patent holdup model,on the basis of the factors of the injunction system,by combining the latecomer characteristics of the enterprise itself,Xiao Yangao,etc(2016)introduces the two factors of technological capability gap and cost advantage between latecomer enterprises and foreign leading enterprises,and constructs a patent holdup model from the perspective of latecomer enterprises,who study the dynamic impact of the technical ability gap,the change of cost advantage on the degree of patent holdup and the anti patent holdup strategy of latecomer enterprises from theoretical deduction and model deduction.Through a questionnaire survey,taking China’s latecomer enterprises in three regions in Sichuan,Hubei and Guangdong,which have obtained patent licensing from foreign leading enterprises as the respondents,this paper has collected data on the gap between Chinese latecomer enterprises and foreign leaders,their own cost advantages,the ratio of actual licensing fees,the strength of patent protection,the structure of the main body and the structure of the patent.Through conceptual model derivation,after putting forward the hypothesis,this paper has empirically studied the influence of the technological capability gap and cost advantage of Chinese latecomer enterprises on the actual licensing fee ratio,as well as the moderating role of the main structure,the patent structure and the intensity of patent protection.The following conclusions are drawn:1)there is a positive correlation between the technological capability gap and cost advantage of latecomer enterprises and foreign leading enterprises.2)The main structure plays an important role in promoting the adjustment for the relationship between the technological capabilities and cost advantages of latecomer enterprises and the actual licensing fee ratio.3)The patent structure and the intensity of patent protection play a moderating role in the relationship between the technological capability of latecomer enterprises and the ratio of actual licensing fees.4)The patent structure has a significant inhibitory effect on the ratiobetween the cost advantage and the actual licensing fee for the latecomer enterprise.5)The intensity of patent protection has no moderating effect on the relationship between the cost advantage of latecomer enterprises and the actual licensing fee ratio.6)The manufacturing capacity of latecomer enterprises has no significant impact on the actual licensing fee ratio.
