Study On China's Legislation Of Geothermal Resources

Energy and environmental are two important issues that constrain the sustainable development of China's economy and society.China's energy constraints are intensifying and energy development faces serious challenges.Traditional energy sources with low efficiency and high pollution have an increasing impact on the environment.Optimizing the energy structure and improving energy self-sufficiency requires active development of renewable energy,which can alleviate the environmental problems caused by coal-based fossil energy,solve the problem of energy shortage in China,and ensure national energy security.Adhere to the concept of sustainable development and coordinate the relationship between economic development and the environment and society.As a green,low-carbon and clean renewable energy,geothermal resources will bring huge economic and social benefits to China.China's geothermal resources are abundant,and the scientific and rational use of geothermal resources will effectively alleviate the problem of insufficient energy supply in China.At present,there are only local laws or departmental regulations regulating the management of geothermal resources in China,and there is still a national unified law missing.Try to enact legislation on geothermal resources to provide legal protection for the development,utilization and protection of geothermal resources.This paper uses literature research,comparative analysis and other methods to develop research on geothermal resources legislation.Through summarizing,the concept of geothermal resources is defined,the distribution and the types of geothermal resources are clarified;Integrating the existing domestic laws,analyzing and studying the current situation of management and shortcomings in which there are unclear responsibilities and multiple political exits;Synthesizing national energy structure adjustment,lack of superior law,geothermal technology,state-supporting new energy,and others related factors,demonstrating the necessity and feasibility of China's legislation on geothermal resources;Drawing on the advanced legislative techniques of the developed countries of the United States and Iceland and absorbing the valuable experience of comprehensive utilization of energy,furthermore,the basic framework of China's geothermal resource law is proposed.To construct a new geothermal resource law,it is necessary to clarify the legislative purpose,set the core principles of the development and utilization of geothermal resources,the practical and feasible basic system,and the legal guarantee for effective implementation.
