On The Perfection Of Environmental Education Legislation

In recent years,the defects of command and control mode of environmental governance became increasingly obvious.Therefore the reform of environmental governance aiming at the new mode of comprehensive environmental governance with factors of negotiation and cooperation is demanding,in which environmental education legislation is a important way.Though China has some relevant legislation now,there are many defects compared with some developed countries' legislation.The history of domestic research of environmental education legislation has been more than 10 years with some academic fruits,but still not enough for theoretic support for our future environmental education legislation,especially considering that the specific environmental education legislation has been in China's legislative plan now.Therefore,further research on the topic is of great importance.Based on the perspective of new environmental governance,this article focus on the perfection of China's environmental education legislation,learning from U.S.law's experience.It is helpful for filling with the defects of current academic research and for our future legislation to refer to.The first part of this article focus on the comprehensive environmental governance and the legal value of environmental education legislation,which analyzes the general theories of environmental education,the reform of environmental governance aiming at the mode of comprehensive environmental governance,the value of environmental education legislation with the perspective of comprehensive environmental governance,etc.The 2nd part of this article introduces and analyzes U.S.law's experience of environmental education legislation with the perspective of comprehensive environmental governance.With raw research materials,it introduces and analyzes the U.S.institutional systems of environmental education,National Environmental Education Act,local legislation and the implement of environmental education legislation in U.S.The 3rd part of this article introduces the background of China's Environmental Protection Act with new environmental education articles and assessed the articles' value and defects.The 4th part of this article focus on the construction of China's environmentaleducation legislation with the perspective of comprehensive environmental governance,which analyzes the systemaltism of China's environmental education legislation and specific environmental education legislation and the basic principals,institutional systems of Environmental Education Act in the future...
