A Study On Legal Mechanism Of Environmental Nimby Conflict

NIMBY conflict have become popular in practice and academic theory.When the NIMBY and becomes the norm in the process of urbanization,and the forms of conflict manifestations are diverse,it has become the most important environmental group action of the public.For the Chinese society in transition,it is difficult to balance the inevitable need to avoid infrastructure construction and the non-negligible public appeal.However,the current legal mechanism for environmental neighbors to avoid conflict resolution is not perfect,and environmental risks cannot be properly solved.The risk of social stability and the increase of governance costs have caused social tensions,which are far from the requirements for the construction of ecological civilization.Only by thoroughly analyzing the development of the avoidance event,truly understanding the needs of the public,ensuring the openness and rationality of the whole process of decision-making,and completing the corresponding legal mechanism,can we effectively solve the dilemma faced by China's environmental neighbors and avoid conflicts.The main part of the article analyzes the research status of environmental neighboring conflicts at home and abroad.Under the support of the study of civil environmental rights theory and environmental justice theory,it clarifies the important concepts of neighboring and avoiding the dilemma facing the reality of China's environmental neighboring conflict avoidance.Causes.Through comparative analysis,the article draws on the experience of successful governance of environmental neighbors and conflicts at home and abroad,and provides useful enlightenment for the legal mechanism of environmental neighbors to avoid conflicts.Finally,from the actual situation,we propose a legal mechanism that is suitable for China's national conditions and perfects the environment to avoid conflict resolution.
