As used herein,district management refers to the division of land use within a national park into different areas to implement district control.Nine provinces have started pilot work,and several legal documents have been issued at the national level to emphasize the importance and urgency of national park construction.As a key part of the natural land protection system,the national park,which is not only different from the development and utilization of scenic spots,but also different from the priority protection of nature reserves,is established to protect the authenticity and integrity,and combine development and protection organically.Due to this orientation,the management of national park cannot completely follow the Nature Reserve Regulations and the Scenic Spots Ordinance.However,for the moment both the lack of legal guarantees and old system barriers hinder the construction and development of national parks;the organic combination of national park establishment and the construction of nature reserves and scenic spots,which are distinguished from but interconnected with each other,can better conform to the basic situation of the implementation of relevant legislation in China at this stage.Therefore,national parks should be effectively distinguished from nature reserves and scenic spots so that they can fully play their important role in the natural protection system.At the same time,we should analyze the institutional defects of nature reserves and scenic spots,integrate existing resources,and ensure the construction of a standardized and efficient national park system.It will not only help the construction of the national park system,but also help solve the historical problems left by the construction of the protected land system,thus building a unified and coordinated natural land protection system in China.This paper first reviews the research status of the district management in national parks,then analyzes the related concepts of national parks,conservation zones,nature reserves and scenic spots,summarizes the problems existing in the process of national park construction and analyzes relevant domestic and foreign legal systems,and finally discusses the theoretical and practical significance and research feasibility of the districtmanagement in national parks.Through analysis and comparative study of the viewpoints of domestic and foreign scholars,this paper draws the conclusion that the biggest problem facing the district management in national parks is the lack of legal protection,unclear allocation of powers and responsibilities of district management and imperfect management mechanism.This paper summarizes the new and old major problems faced by the national park district management by analyzing the relevant national park legal documents and existing laws and regulations on nature reserves and scenic spots.Finally,this paper tries to give a solution to the problems that national parks may face in district management: as for the lack of legal guarantees for district management,trying to improve the legal status of national parks from the formulation of independent national park laws;on the issue of allocation of powers and responsibilities in district management,emphasizing the division of powers and responsibilities of central and local authorities and departments and the establishment of the national park authority;on the improvement of the district management mechanism,focusing on adaptation to local conditions,standards of definition of different national park districts and the scientific division of dynamic districts,so that the whole nation will work together to establish social supervision and disputes can be properly handled through regional coordination,thus to improve the district management mechanism.
