Research On The Legal System Of National Park Franchising

The The "Overall Plan for Establishing the National Park System" issued in 2017 has determined the importance of national park franchising.From the perspective of the country,environmental protection and society,the national park franchising legal system that is accurate,efficient,environmentally friendly and shared by all can promote.The smooth operation of national parks can make the development of national parks more sustainable and enhance people’s good recreational experience in national parks.At present,the construction of the legal system of national park franchising is still in the initial stage and needs to be continuously improved.From the perspective of the legal system,the national park franchise is studied,and the systemic research is carried out from the three major elements of franchising subject,franchising content and how to franchise.From the status quo of national park franchising,find out the existing problems of each element,analyze and study and learn from foreign experience,and finally try to solve the problems.First,the connotation of national park franchising is explained,the system logic of national park franchising is analyzed,and the necessity of research is clarified.Secondly,it analyzes the specific problems of national park franchising in my country.The main issues are the lack of clarity on the rights and responsibilities of the management body,the unreasonable scope and content of the franchise,weak supervision,insufficient consideration of community development interests,and lack of franchisees’ selection and exit mechanisms.Thirdly,through the analysis of national park franchise operations in the United States,New Zealand,Canada,and Japan,we summarize the experience suitable for our country.Finally,it puts forward suggestions on the optimization of my country’s national park franchise legal system.In terms of legislation,it emphasizes the unity of franchise legislation and adheres to the legislation of each park.In terms of specific issues,clarify the powers and responsibilities of the competent authority;limit the scope of franchise project operations and make a detailed list of contents;through exploring appropriate regulatory models,formulating regulatory standards,and multi-party participation in supervision;innovating community participation methods,scientifically feeding the community,and improve the development ability of the community;improve the franchise operator’s selection and exit mechanism.Through the above research,improve the legal system of national park franchising and promote the development of national parks.
