Since industrial civilization,mankind has always held an attitude of conquering nature for economic development.But after the 21 st century,human beings are awakened to fear nature.As a result,there have been many related systems for nature protection,and today’s national parks are a new type of protected area development model respected all over the world.The construction of national parks will play a major role in the establishment of national image,national identity,national common consciousness and national cohesion,and provide an important way to achieve the ultimate goal of effective protection of public resources and sustainable public enjoyment.Our country attaches great importance to the protection of the ecological environment.Since the Third Plenary Session of the Eighteenth Central Committee of the Communist Party of China proposed the "construction of a national park system",it has actively explored the construction of national parks.At present,the pilot work of national parks in our country is also steadily advancing,and a development path of a nature reserve system with Chinese characteristics has gradually formed in line with China’s national conditions: nature reserves are dominated by national parks and protected by national park systems.The reason why national parks are the main body of nature reserves is that national parks are different from other nature reserves.They are distinguished from each other and related to each other.They are a sign of hierarchical,integrated and unified management.Today,my country’s management system for other nature reserves is becoming more and more perfect,but there are still many problems in the management system of national parks.These problems will lead to insufficient protection of national parks in our country and make the ecological environment unable to improve.Wild animals and plants Habitats are fragmented and biodiversity is drastically reduced.Judging from the current laws and regulations,the legislative model of national parks in my country adopts a bottom-up model,which leads to the highest level of legal effect of national parks at present is the local regulations.Although it can fully demonstrate its particularity in the pilot project,it is easy to be confused without the legislative guidance behind it.my country’s national park management system mainly includes the division of powers between the management subject and the management subject,as well as the supervision of the management behavior of the management subject.In terms of the nature of the management body,the current state of my country’s national park management body is unclear and inconsistent,which makes it impossible to achieve the main goal of my country’s national park system construction,that is,"unity,standardization,and efficiency." In terms of the division of powers between management entities,the local government should have cooperated with the management work of the national park management agency,but in practice,the local government has interfered too much,mainly reflected in the ownership of natural resource assets,franchise rights,law enforcement rights,etc.The use of.In terms of supervision mechanism,my country’s national park system pilot projects have few regulations on supervision methods,and the public’s supervision power is not paid attention to.In order to complete the goal of the "Overall Plan for Establishing the National Park System",it is necessary to straighten out the problems that have arisen in the current national park management system in my country.The article first explains the concept and characteristics of national parks,and distinguishes national parks from other nature reserves,with the purpose of highlighting the particularities of national parks.In addition,it defines the concept of my country’s national park management system and expounds the development process.Secondly,this article uses the current laws and regulations as the background to compare the legal nature,division of powers and supervision mechanism of each national park system pilot in my country.Thirdly,the experience of the management system of national parks in the United States is sorted out;finally,through the application of literature research method,comparative analysis method and interdisciplinary research method,the conclusion is that to improve the vertical management system of national parks in my country,the current legislation should first be improved.The system is designed for the top-level design of the national park management system in my country,so that the nature of the management subject,the division of powers and the supervision mechanism can be clarified,and the improvement of the national park management system not only has strong operability in the legal construction of national parks,but also It also has positive practical significance for scientific development and ecological protection.
