Study On The Environmental Protection Supervision System In China

Since the reform and opening up,the acceleration of industrialization and urbanization has led to more and more environmental damage.In order to solve this problem and better protect the environment,China has established an environmental protection supervision system,but there are still big defects and legal difficulties in practice.This paper first elaborates on the concept,characteristics,functions and system overview of the environmental protection supervision system,in which the definition of the environmental protection supervision system refers to the implementation of laws,regulations and policy standards by relevant institutions,as well as the supervision and inspection of serious pollution events and ecosystem damage events.The functions of the environmental protection supervision system include: effectively supervise the implementation of local environmental policies,regulations and standards,better deal with problems related to environmental pollution,better deal with problems related to ecological destruction,and better deal with problems related to cross-regional environmental pollution and ecological destruction.Environmental protection inspectors have the characteristics of comprehensive object,comprehensive content,comprehensive means and comprehensive purpose.Secondly,the basic theory of environmental protection inspector is analyzed.The theoretical bases mentioned in this paper include administrative supervision theory,policy implementation theory,public trust theory and national environmental protection obligation theory.Again through the main supervision system in China,such as land supervision system,Marine supervision system and foreign relevant supervision system for example,the Russian state land supervision system,the regional environmental protection supervision system,the British planning inspectorate system,the Dutch housing,space planning,and based on the analysis of the environmental supervision system,studies its enlightenment for China's environmental protection supervision system.We can draw lessons from the experience of China: perfect legal basis of environmental protection supervision,clear legal status of environmental protection supervision specialized agency,perfect provisions on the rights and obligations of environmental protection supervision specialized agency,comprehensive accountability mechanism of environmental protection supervision,strict supervision of environmental protection supervision specialized agency,and perfect accountability procedures of environmental protection supervision.Finally,the construction of environmental protection supervision system in China is proposed.Firstly,it includes the legislative concept and basic principles of environmental protection supervision system in China.Secondly,it is about the specific system construction of environmental protection supervision,including authority system,procedure system,responsibility system,environmental protection objective responsibility system and assessment and evaluation system.
