The permit system for pollutant discharge is a system in which the environmental protection department,on the basis of the application of the pollutant discharger and after examination,permits the pollutant discharger to carry out the pollutant discharge behavior in strict accordance with the requirements of the pollutant discharge permit record,and supervises the pollutant discharge behavior throughout the process.The emission permit system has the characteristics of whole process and comprehensive,so it is the key system to solve the increasingly serious environmental problems in our country.In order to reduce environmental pollution and improve environmental quality,it is necessary to reform the emission permit system.It is necessary to sort out the relevant basic theories to reform the permit system of pollutant discharge.Combining with the concept and basic content of the emission permit system,it is clear that the emission permit is the carrier of the emission permit system,and the emission permit system is realized through the emission permit system.Based on the background and reasons of the reform of emission permit system,the goal of the reform of emission permit system is put forward,that is,to establish a mature legal and regulatory system,and to realize the integration of emission permit system and other environmental protection systems.It is necessary to clarify the unreasonableness of the current emission permit system in China in order to carry out the reform of the emission permit system.Based on the legislative overview and implementation overview of the implementation of the emission permit system for 30 years,combined with some data and typical cases,this paper reveals the existing problems of the emission permit system,including unclear functional orientation of the emission permit system,small scope of pollutants applicable to the emission permit,over-principled division of powers among regulatory bodies,insufficient disclosure of information,which makes it difficult for the public to participate,and environmental impact assessment.There are six problems in the connection between price system and total quantity control system.The European Union uses a comprehensive emission permit system.The United States has the most perfect emission permit system.The British environmental permit system has special institutional advantages.The implementation of the emission permit system in these three countries or regions has achieved good results,giving full play to the role of the emission permit system.It has the title of legal status,applicable pollutant scope,regulatory system,public participation and environmental protection system.The following five aspects can selectively absorb reasonable experience,which is conducive to the reform of emission permit system in China.Through the following suggestions,we can reform the emission permit system in China: clarifying the core position of the emission permit system is conducive to the integration of environmental protection system with the emission permit system as the core;implementing the "one-card" comprehensive permit management to achieve the full-cycle management of the emission behavior;refining the division of authority among the main levels of supervision,improving the efficiency of supervision and reducing the administrative composition.In order to improve public participation and make up for the shortage of environmental protection,we should integrate the environmental protection system,take the environmental impact assessment system as the pre-procedure of the emission permit system,and take the total amount control system as the basis for establishing the emission permit,so as to give full play to the overall advantages of the environmental protection system.
