Study On The Legal System Of Water Pollution Discharge Permit

China is a country rich in water resources,but with the frequent activities of human beings and the use of various chemical raw materials,industrial wastewater and domestic sewage have caused great damage to water bodies and water quality.Therefore,one of the important contents of the current environmental protection work is the prevention and control of water pollution.If we want to do a good job in preventing and controlling water pollution,the top priority is to start from the source,so a series of point-source control systems have been formed in the environmental legal system,such as total control,emissions trading rights,and emission permits.The legal system of water pollution sewage permit is a kind of environmental protection system that hopes to curb the pollution behavior of enterprises from the source.This system is to control the total amount of sewage wastewater discharged to achieve the purpose of protecting the cleanliness of water quality.This article is divided into five parts.The first part is an overview of the legal system of water pollution and sewage discharge license.This chapter mainly introduces the concept of the legal system of water pollution and sewage discharge license.By comparing the legal system for water pollution and sewage discharge permits with the legal system for air pollution and sewage discharge permits,other environmental protection systems and other administrative licenses,the characteristics of the legal system for water pollution and sewage discharge permits are analyzed.The related theories of the construction of the legal system of water pollution and sewage discharge and the historical development of the legal system of water pollution and discharge permit are introduced.The second part is the current situation of water pollution and the legal system of water pollution and sewage discharge license in China.The third part is an assessment of the current status of the legal system for water pollution and sewage permits derived from the analysis of the previous part.The problems such as inadequate legislation,inadequate supervision,lack of talentselection mechanism,financial guarantee mechanism and imperfect accountability mechanism are analyzed.The fourth part introduces the relevant legal systems of foreign countries and Taiwan region of China.This paper introduces the legal system design parts of foreign legal systems for water pollution and sewage pollution license system and Taiwan region of China.And get corresponding experience and enlightenment from it.The fifth part is aimed at the problems analyzed in the third part,and the fourth part is about the advanced institutional experience in China and Taiwan.It proposes to establish administrative regulations,strengthen local legislation,improve the management system and supervision mechanism,and clarify the funding guarantee and talent selection mechanism.Legal recommendations such as strengthening accountability mechanisms.
