A Study On The Legal System Of Pollutant Discharge Permit In China

Our country is in the key period of "two winning one hundred years ",entered the construction phase of a new historical position,nineteen big held is proposed to fight pollution prevention and control of the battle,therefore,environmental pollution has become an important step in boosting the construction of a new era.One of the most important legal system of environmental management in our country for the emission permit system,by the central government and respected local level,but its practical application in concrete also showed some limitations,if we can timely solve these problems and improve,is able to add the key to the construction of environmental protection in our country the power of.The article is divided into five parts.The first part is the introduction,the research background and significance,this paper mainly introduces the current situation,research contents and research methods;the second part is an overview of the legal system of pollution discharge license in China,mainly introduces the basic concept,the system of pollution permits principle,theoretical basis and system characteristics;The third part of the study of our country’s central and local legislation,summed up the system problems in our country;the fourth part of the licensing system of China’s pollution problems with experiences of Sweden and the United States and Taiwan,the reference from the enlightenment;The fifth part is the suggestion to improve the system,the construction aspects of coordination and integration,the punishment mechanism from the formulation of legal documents to modify,participate in the rights and obligations of the principal division,and other environmental legal system,hopes to put forward on these suggestions,can enlighten the legal system for the construction of sewage licensing mode I in our country,and to promote the effective implementation of the emission permit legal system.
