The Study On The Legal System Of Classification And Recycling Of Municipal Waste In China

Along with the development of urbanization in China,the phenomenon of “garbage besieged city” has become increasingly prominent.The reduction and recycling of urban domestic garbage have become major problems that need to be solved in the construction of urban ecological civilization in China.This urgent and realistic demand urgently needs to improve the legal system for the classification and recovery of urban domestic waste in China,thus providing legal guarantee for preventing urban garbage pollution and promoting the development of urban circular economy.This paper comprehensively applies the basic theories of environmental law and circular economy,and adopts research methods such as literature analysis method,norm analysis method and comparative analysis method.The thesis is divided into five chapters to discuss the legal system of municipal solid waste separation and recycling in China.The first chapter is the introduction,which discusses the research background,the significance of the topic,the research status at home and abroad,and the research content and main research methods of the thesis;The second chapter is an overview of the legal system for the classification and recycling of municipal solid waste,mainly discusses the concept of municipal solid waste recycling,the theoretical basis and the practical va lue of the legal system for the classification and recycling of municipal solid waste;The third chapter examines the current situation of the legal system for the classification and recovery of municipalsolidwaste in China,and summarizes the provisions of the relevant regulations on waste separation and recycling in the Constitution and laws,administrative regulations and departmental regulations,local regulations and government regulations and policy documents.On the basis of the analysis,the existing system dilemmasare analyzed,namely: the legal system for the classification and recovery of municipal solid wastehas not been systemized,the special legislation for the classification and recycling of municipal solid waste is not perfect,and the suppor ting system for the classification and recovery of municipal solid waste is not perfect;The fourth chapter examines the comparative legal system of domestic municipal solid waste separation and recovery,mainly introduces the legal system of municipal sol id waste separation and recovery in developed countries such as Japan,Germany,the United States and the United Kingdom.content,On this basis,it summarizes the enlightenment of extraterritorial system experience to China;The fifth chapter summarizes the countermeasures to improve the legal system for the classification and recovery of municipal solid waste in China: namely,the improvement of the municipal solid waste separation and recycling legal system,the municipal solid waste separation and recycling special legislation and the municipal solid waste separation and recovery supporting system.
