Research On The Legal Regulation Of Municipal Solid Waste Classification Based On The Theory Of Multiple Co-governance

“Besieged by Waste” is a new problem in the social governance accompanied by industrialization,urbanization,and consumerism,which challenges the modernization of urban governance system and capacity.It is an effective way to realize the reducing,recycling,innoxious disposal of municipal solid waste(MSW).China takes full account to ecological and environmental governance.With the enforcement of the local laws and regulations represented by the Regulation for the Administration of MSW in Shanghai,the classification of MSW has entered the public view with unprecedented attention,and MSW classification has become a “new fashion”.However,China's system of MSW classification started late,there are problems such as poor legislative operability,inadequate supporting measures,unclear legal status of public participation and backward governance means.The theory of Pluralistic Co-governance provides a good governance path for the legal regulation of the classification of MSW.This theory is based on cooperative administration and procedural environmental rights.The theory has the characteristics of pluralistic governance subjects,cooperative governance modes and networked governance structure.It is feasible and necessary to introduce the theory of Pluralistic Co-governance into the classification of MSW in China.The theory of Pluralistic Co-governance has made corresponding achievements in the field of current grassroots governance in China and has the conditions to be applied to the field of MSW classification.Based on the theory of Pluralistic Co-governance,China should reconstruct the system of government administration,legal regime on economic and public participation system,and optimize the legal regulation system for the classification of MSW.Based on the theory of Pluralistic Co-governance,the legal regulation of the classification of MSW in China needs to be improved in the following aspects: first,improve the government supervision system for the classification of MSW,establish a scientific mechanism for the classification and management of MSW,strictly supervise and inspect the classification of MSW,and improve the education system for the classification of MSW.Second,improve the legal regime on economic of Pluralistic Co-governance,gradually establish a garbage tax system,introduce social capital to participate in the classification of MSW,and improve various supporting measures.Third,improve the public participation system of Pluralistic Co-governance,define the legal status of public participation,guarantee the public's extensive and full right to participate,and improve the publicity and guidance mechanism.
