A Study On Administrative Accountability Of Chemical Safety Accidents

Administrative accountability plays an important role in strengthening the supervision and restriction of public power,promoting the construction of political civilization and the modernization of governance system and capacity.In 2003 after the SARS outbreak,the reflection on the realistic problems to promote level of administrative accountability theory and practice of exploration,after more than ten years of development,in the modern sense of administrative accountability towards institutionalization and rational development,governments at all levels began to strengthen the construction of policy text of administrative accountability and the operation practice of exploration,and has set up basic framework of the system of administrative accountability in our country.In recent years,frequent chemical accidents have caused great economic losses to all aspects of society.The strong accountability of officials involved after accidents is not the focus and purpose of administrative accountability,and strengthening the implementation of safety supervision responsibility is an effective manifestation of the effectiveness of administrative accountability.However,the practical problems in the practice of administrative accountability in chemical accidents do affect the effectiveness of administrative accountability.First of all,this paper expounds the research background and significance from the current severe situation of frequent chemical safety accidents,the national emphasis on safety in production and supervision of hazardous chemicals.On the basis of relevant literature,policy texts and accident case analysis,the author established the analytical thinking of"administrative accountability is the process of accountability subject conducting liability investigation on the object of accountability according to the established responsibility standards" from the perspective of the concept of administrative accountability,and set the writing framework.Based on the theory of government by rule of law,governance and good governance,the two theories provide theoretical basis for the article's framework,dilemma analysis and path analysis.Taking the current effective policy text of administrative accountability in the field of production safety accidents and 16 cases of serious and very large chemical accidents as the analysis objects,the author explores the plight of administrative accountability of chemical safety accidents through text analysis method,namely the plight of system,subject and object.First of all,the institutional dilemma of administrative accountability is mainly reflected in the lack of legal basis of existing policy texts,the lack of system(the lack of unified high-level statutory law),and the ambiguity of system(the unclear content of accident accountability).Secondly,the main dilemma of administrative accountability is mainly manifested as the dual weakness of the same accountability and allogeneic accountability.In the process of implementation,there exists the problem of free discretion and responsibility which is difficult to define clearly,while the news media,the public and the power organs appear the phenomenon of aphasia and absence in the process of participation.The object dilemma of administrative accountability again mainly shows that the object of accountability is not clearly defined.The accountability results of officials at different levels are obviously different and show unbalanced characteristics,that is,the reality deviation of the object of administrative accountability.Finally based on the above all sorts of difficulties in the process of administrative accountability running,combining the theory of the rule of law government and governance and good governance theory put forward the perfect path,from the form of administrative accountability legalization and nature under the rule of law,establish a sound administrative accountability system specification and promote accountability force,various main responsibility clear boundaries,etc,to promote realization of administrative accountability system,the government by law development.
