Research On Legal Issues Of Pollutant Discharge Permit In China

As one of the core systems of environmental management of fixed pollution sources,pollutant discharge permit management system plays a very important role in environmental protection in China.Since the reform of China's pollutant discharge permit management system was launched in 2016,obvious results have been achieved to some extent.At the same time,problems arising in the pollutant discharge permit management work have become increasingly prominent.Whether these problems can be effectively solved is of great importance to the comprehensive implementation of China's pollutant discharge permit management system and the promotion of ecological civilization construction.Based on the latest situation of China's pollution permit management practice,this paper combs and studies the legal issues related to the pollution permit management system.First defining the relevant concepts for sewage discharge permission management system,and through the legislation and practice two aspects to analyze the management of pollution permits in the status quo,to find the pollution discharge license management system still exist many problems,such as: the applicable scope too narrow,enterprise's main body responsibility is not strong,weak internal management mechanism,sewage,licensing and regulation,the separation after the regulation to carry out the poor,the lack of effective public participation,and lack of related legal system of environmental management,etc.To Europe and the United States and other developed economies through study of tradable permits the practice of the management system,and based on the basic reality of national conditions in our country,and then to improve the tradable permits management work put forward the following Suggestions: expanding the applicable scope,the strengthened enterprise's main body responsibility,and internal management mechanism,strengthen the third-party service agencies participation,stepping up efforts in supervising,the effective connection,effective implementation of public participation and related environmental management system.It is hoped that the research in this paper can provide some reference for perfecting the pollution discharge permit management system in China.
