In recent years,with the rise of online shopping and the rapid development of e-commerce economy,the business volume of express industry has ushered in an unprecedented growth.At the same time,a large number of express packages along with express commodities have caused pressure on the environment and resources,and various environmental and resource problems have gradually emerged:The amount of waste produced by the discarded express packaging is huge and keeps a high growth rate,which pollutes the urban and rural environment;No doubt,the large amount of it also adds pressure to the treatment of urban garbage.Because some packaging materials are poisonous and harmful,it is easy to cause secondary pollution in the process of treatment;The production of express packages consumes a lot of natural resources and the recovery rate is very low.These problems are caused by the fact that enterprises only pay attention to economic benefits and ignore environmental factors in the process of economic development,as well as the reason that the state's supervision of green packaging in express delivery industry is not sound and lacks special legal regulations.From the perspective of regulating the green packaging of express industry by legal system,this paper discusses the way of national special legislation,trying to set the power and responsibilities of the government,the rights and obligations of enterprises and consumers in the process of production,design,circulation,recycling and disposal of express packaging.And then set the mandatory and non mandatory behaviors of the government,enterprises and consumers.In order to standardize,it is necessary to make specific regulations on the code of conduct to be observed and the legal responsibilities to be undertaken,and to learn from the advanced experience of foreign countries,to comprehensively manage the non green packaging behavior of the express industry by the combination of administrative and economic means,so as to form a systematic,efficient,scientific,reasonable and specific applicable governancestandard.We should further make specific regulations on the code of conduct and the legal responsibility it should bear,and use the advanced experience of foreign countries for reference,and use administrative and economic means to comprehensively manage the non green packaging behavior of the express industry,so as to form a systematic,efficient,scientific,reasonable and practical governance standard.
