Research On Legal System Of Agricultural Non-point Source Pollution Prevention And Control In Shandong Province

Humanity has never stopped the pollution control.Nowadays,agricultural non-point source pollution has been intensified and intensified with its unique concealment.The complexity of its harm and governance is far more serious than the surface.Shandong Province has become a national agricultural product supply base with its developed agricultural production,but the aggravation of agricultural non-point source pollution brought about by the back can not be ignored.While strengthening scientific and technological research,in order to achieve the desired governance effect,there must be sound legislation to provide strong protection and support.This paper first introduces the research background and significance of agricultural non-point source pollution in the introduction;the second chapter explains the general situation of agricultural non-point source pollution in Shandong Province.Agricultural non-point source pollution refers to the pollution of water environment caused by nitrogen,phosphorus and other organic substances,pesticides and other chemical pollutants generated in agricultural production activities through surface runoff or through soil infiltration.Instability,randomness,decentralization,difficulty in discovering and difficult to monitor characteristics;this paper discusses the theoretical basis of agricultural non-point source pollution prevention through urban and rural environmental justice and intergenerational environmental justice;in addition,the current Shandong agriculture The source and cause of non-point source pollution were studied and analyzed.Secondly,it analyzes the shortcomings of the legal system of agricultural non-point source pollution prevention and control in Shandong Province and discusses the references of foreign legislation.Existing problems include: lack of single-line legislation,stale legislative concepts of existing legal systems,poor operability and coordination of legal provisions,lack of civil liability and criminal liability for environmental legal responsibilities;references include: various sources of pollution The prevention and control laws are meticulous and complete,the system is coordinated and operable,the law is coerced with the economic stimulus,the citizens' right to know is expanded,the public is encouraged to participate,and the accountability system is refined.Finally,on the basis of drawing on foreign advanced experience and combining with the provincial conditions of Shandong Province,we will establish a separate legislation for the prevention and control of agricultural non-point source pollution in Shandong Province.The specific contents include: establishing a green,coordinated and sustainable guiding ideology;The principle,the principle of economic stimulus and the principle of public participation;the basic system is divided into two aspects: the preventive system and the governance system of agricultural non-point source pollution,including pollution source emission reduction,other preventive legal systems,special rectification systems for key issues,and multiple parties.Coordinated monitoring systems and emergency response systems.
