Research On Legal Risk Management Of A Company

With the continuous development of China’s market economy,the laws and regulations of enterprises have been gradually improved,and the relevant legal construction of enterprises has been progressing.For businesses,therefore,need to focus on implementation of relevant laws and regulations,real-time to company laws and regulations as the basis to build in-house legal risk management system become a necessary task of every enterprise daily business activities.It is foreseeable that in the near future,legal risk control will become a key area of enterprise operation.The main points of this study are as follows:(1)the problems existing in the legal risk A Construction Company: in general,A Construction Company’s legal risk management has many challenges,such as the method of legal risk consciousness weak,the lack of perfect legal risk control system,contract management,lack of norms,"contract of Yin and Yang" buried risk potential,the group headquarters and subordinate company lack of high quality talents,insufficient legal management function.Company A legal risk management of the main causes of these problems include group headquarters and subordinate units leading to insufficient legal risk attaches great importance to the management system,lack of specification and in the evening,causing legal risk prevention lacks basic,group headquarters and subordinate units reasons such as lack of legal risk management culture.(2)A Construction Company legal risk countermeasures: improve the capacity based on the problems existing in the legal risk management A Construction Company,this paper puts forward the following measures improving the capacity of A Construction Company’s legal risk management,specific as follows: first,to establish and perfect the system of legal risk management,and resume the law review and decision system,including perfecting the system of contract management,strengthen the group headquarters to the subordinate unit controls,set up legal review system,establish A major decision evaluation system;Second,optimize business process system,identify key risk areas,specific include functions,from a macro level optimization department stop function is missing,guard against legal risks and micro level analysis in the business,improve the business rules and regulations;Third,the establishment of legal risk prevention specialized training institutions,legal risk management organization,including building group,branch and project department level 3 legal risk management organization,strengthen the selection and evaluation,comprehensive legal talents to form a legal talent team management;Fourthly,we should raise the awareness of legal risk management and create a good legal risk culture.This study will help to improve the legal risk management ability of A Construction Company,and also provide guidance for other enterprises in the construction industry.But also some deficiencies in this paper,we study,the main show is not for A Construction Company do some in-depth study of specific legal risk,which is A Construction Company in the future construction of legal risk prevention system need to focus on the topic.
