Research On Practical Method Of International Engineering Duration Claim Based On FIDIC Clause

Economic globalization is increasing,the international trade situation is deeply integrating,and international engineering contracting industry is progressing with each passing day.Chinese enterprises also belong to the rising star in the process,who show the large strength but not strong.With obviously normalization of Chinese enterprises “going out” to carry out international engineering investment and contracting,difficulties occur: International engineering with multiple uncertainties,the contract hidden risk one after another,the frequent events of delay,the urgent demand for claims.This paper mainly studies the practical engineering method of international engineering delay claims based on the FIDIC clause.By comparing the basis of the contract terms,combining the actual project management experience,considering the qualitative and quantitative analysis,the simple calculation method is obtained for the international large and medium contractor to explore a facilitated operation method during the deadline.The main conclusions are as follows:By comparing the terms and conditions of the contract,it is concluded that the contractor’s claim in the FIDIC New Redbook are up to 25 terms,including the general terms and special terms of the claim and other implied terms of the obligations of the owner.Those provisions are basically available in the Minas project Contract respectively.All the delay claims should be based on the notice giving by the contractor in time after the incident occurred.With the contractor’s own practical experience,it is concluded that the international engineering delay claims require the standardization management of the whole process.From the record and the report of the delay event,to the archives management of the claim document,to the subsequent processing of the claim event.The whole process must be sorted and standardized,for the purpose of effective management.Only the basic information is reliable,the bases of contract are full and firm,the claim is reasonable,the long-term claim management is insistent,it is possible to gain the achievement of the claim.Based on the qualitative and quantitative analysis of the delay calculation of the construction period delay,combined with the negotiation strategy and practical experience of the delay,a convenient method of calculating is acquired: the actual delay tracking method of the key path.This method only needs to calculate according to the actual delay of the key path.The principle of fact is easy to get the understanding of the owners.With the clear calculation principle and the simple calculation process,it is easy to form a win-win cooperation outcome.On the basis of a large number of theoretical work,this paper proposes a method to facilitate the implementation of the international engineering time claims based on the FIDIC clause,which is validated in the actual project case,from the single delay event claim to the milestone node duration claim to the total duration Claims and cost claims,from the different levels of the facilitation of practical practice method of verification,the results show that the key path of the actual delay tracking method of reliability,worthy of promotion.
