The improvement of the status of human resource management in the development of enterprise management puts forward higher requirements for the compliance management of human resources.Under the circumstances of the increasingly sound state-related labor laws and regulations and the growing awareness of workers' rights protection,human resources management in enterprises faces greater legal risksThis topic mainly combs the legal risks of human resources management in H company according to the provisions of Labor Contract Law,and finds that there are legal risks in recruitment,employment,signing,alteration,termination and atypical labor relationship management of human resources management in H company.Then,through the method of Brain storming and Fishbone analysis method,this paper analyses the causes of the legal risk of human resources management in H company.It is believed that the causes are historical reasons,insufficient understanding of personnel's ideology,insufficient investment in management and inclined protection of workers by current labor laws and regulations.On this basis,preventive strategies are put forward from the following dimensions:strengthening the rule of law,increasing management investment,improving the system,strengthening staff training and development,proposing amendments to laws and regulations,and standardizing human resources management activities on the basis of existing laws and regulations.Specific measures include defining employment conditions in the recruitment process,rationally planning the duration of each labor contract,signing non-fixed-term labor contracts with employees who meet the conditions according to the law,standardizing the management of overtime and overtime pay,changing labor contracts in written form,prudently unilaterally terminating labor contracts,and recruiting dispatched workers by labor dispatching companies within the limited scope and limitation.To use dispatched personnel and supervise the social security payment of dispatched personnel in proportion,to pay the remuneration of part-time employees in time according to the prescribed period,to negotiate and declare that the agency shall pay the industrial injury insurance for part-time employees,and to standardize the management of borrowed workers.It is hoped that the research of this topic can effectively prevent and control the legal risk of human resources management of H company,and also provide reference for other units in human resources risk management.
