| Based on the study of foreign laws and draft domestic legal advice,the author summarizes understanding of the definition of companion animals and expounds the characteristics of companion animals.After analyzing and understanding the views of domestic scholars on the legal status of animals,their views are divided into "subject theory" and "object theory".It is suggested that animals should be objects in legal status,but different from general objects,animals can be protected as special objects.Animal rights theory and animal welfare theory are the basic theories on how to protect companion animals.The author thinks that there is no contradiction between the two theories.Both theories agree to protect animals,give them benefits.The difference between the two is a mild or radical view when it comes to protecting animals.Based on the present situation of companion animal protection and the social harm caused by the present situation,this paper expounds the necessity of protecting companion animal welfare,and discusses the feasibility of companion animal welfare protection from the aspects of material,culture,mass foundation and organization.Through the introduction of relevant laws in foreign countries and regions,the author starts with the anti-abuse,abandonment and supervision system of companion animals,and draws on their mature legislative experience to provide reference for the welfare protection of companion animals in China.Through the analysis and summary of the above contents,from the protection system of companion animals and the management system of companion animals,several legislative suggestions are put forward to reduce the abuse and abandonment of companion animals,and to strengthen the management.Not only for the companion animals themselves,but also for the long-term interests of harmonious development between human beings and animals. |
