Research On The Legal System Of Companion Animal Welfare In China

Companion animals are animals that can live and communicate with human beings.With the improvement of China’s economic development level,breeding is becoming more and more popular in recent years,which can meet the emotional needs of human beings and promote the development of pet economy.However,the survival status of companion animals is not optimistic.Excessive human intervention in the breeding of companion animals,lack of professional feeding knowledge,abandonment,abuse and even eating of companion animals at all stages,there is a phenomenon that the basic welfare of companion animals is infringed,which not only damages the companion animals themselves,but also affects the safety and stability of human society and the mental health of citizens.The reason is that the restriction of moral consciousness and the existing laws are not enough to protect the welfare of companion animals.The author believes that it is appropriate to protect animal welfare rather than animal rights in China at the present stage,and companion animals are legal objects with "special legal status".At present,it is necessary and feasible to legislate for the welfare of companion animals in China,which is reflected in the prominent social contradictions caused by companion animals,the existing legislation on companion animals is limited to dogs,the great differences between domestic and foreign legislative ideas,purposes and contents,and the people’s enthusiasm to participate in the legislation.On this basis,the author first conceives that the legislative purpose of China’s companion animal welfare legal system should be to protect companion animals,realize the harmony between man and nature,and stabilize social order.Secondly,the legislative principles include the minimum protection,the responsibility of breeders and the public participation.Finally,according to the five stages of breeding,trading,feeding,supervision mechanism and accountability of companion animals,and drawing lessons from foreign experience,this paper puts forward specific systems suitable for China,in order to reduce social contradictions and build a harmonious ecological environment between man and nature while ensuring the basic welfare of companion animals.
