Study On The "Three Rights" Separation Reform Of Collective Forest From The Perspective Of Stakeholders

At the present stage of the reform of collective forest property right system,the state proposes the concept of "three rights" separation of collective forest and issues a series of policy guidance documents.The issue of a policy is not a product of simple decision-making,which involves two factors: real demand and system supply.Therefore,from the perspective of property rights supply and demand,this paper makes relevant research on the "three rights" separation reform of collective forest,analyzes the motivation,path of reform and the demands of stakeholders,answers the current real problem of whether the supply of property rights meets the demand for property rights,and puts forward targeted suggestions for policy improvement on the basis of reality.The research path of this paper is as follows: firstly,through literature review,according to the perspective of supply and demand of property rights,this paper analyzes the institutional changes of collective forest property rights since the founding of the people's Republic of China,and analyzes the property rights characteristics of the separation of "three rights" of collective forest in the current stage,and discusses the reform motivation.Then through the discussion of the specific content of the implementation of the reform of the "three rights" separation of collective forests in Zhejiang and Anhui Province,the paper analyzes the path of the implementation of the "three rights" separation and discusses the progress of the reform of the "three rights" separation from the perspective of the evolution of property rights,and summarizes the effect of the implementation of the reform.Finally,the paper defines the stakeholders of the "three rights" reform of collective forest through stakeholder analysis,discusses the cognition of stakeholders on whether the supply of reform property rights meets the actual demand,if not,what is the interest demand of the policy? Through game analysis,it analyzes the availability of its interest demand,and puts forward suggestions for policy improvement according to the analysis results.The research results of this paper are as follows: the reform of the "three rights" division of collective forest comes from the double impetus of the traditional circulation mode which can not meet the demand for the acquisition of mortgage right and the government's hope to promote the circulation of forest land and realize the scale management by releasing the management right;the woodland management certificate,as the carrier of woodland management right,is an effective way to realize the property right supply of "three rights" division reform;the property right supply of "three rights" division guarantees the rights of stakeholders and promotes the circulation to a certain extent;the supply of property right of forest land management certificate expands the path of circulation mortgage financing,but can not solve the inherent defects of forest right as collateral;the supply of property right at the present stage of reform basically meets the needs of all stakeholders,but the reform is not effective enough,and effective improvement path should be obtained under the game of demands of all stakeholders.Finally,the policy suggestions for improving the path are as follows: to improve the legal and regulatory system of forest right transfer;to speed up the construction of forest right information sharing platform and strengthen the supporting reform;to standardize the evaluation standards of forest assets and improve the evaluation mechanism of forest right value;to systematically summarize and develop the financing methods suitable for the characteristics of forest operation and innovate the financial products;to further standardize the forest right transfer contract and increase the flow of forest land Transfer the issuing strength of forest land management right.
