In recent years,there is increasing concern about the rights issue in our academic circles,"rights" has become the basis for people to think about political philosophy and philosophy of law,and even the so-called "rights era".Moreover,with the rapid growth of the economy and the improvement of status in the world,the call for re-understanding of Confucianism is also emerging.In this environment,whether there is "the concept of rights" in Pre-Qin Confucianism has become a hot topic in academic concern.As we all know,the concept of modern rights is the Western exotic,it is the product of the Western enlightenment.But this does not mean that China hasn't traditional rights.From the literature,we find that the idea of rights is an unspoken theory in Chinese traditional culture.Especially in the period of Pre-Qin,the thought of philosophers involved a lot of rights,these ideas are more in line with our traditional cultural characteristics,compared with the theory of rights in the West,it has great significance to our rights construction today.Through the study we found that the concept of rights can be explained in Pre-Qin Confucian system.This explanation is mainly focused on:First,the rights of Pre-Qin Confucianism mainly refers to human rights including the right to defend people's life,dignity and how to motivate people to be more perfect and noble.Second,Pre-Qin Confucian attach importance to human rights.The emphasis on the social rights of the gap between the rich and the poor;the importance of the political rights and interests of the people,that the sovereignty belongs to the people,Confucianism advocates that people use violence to overthrow the rights of tyranny.Thirdly,the Confucian thought of rights is mainly embodied in the spirit of political ideology,such as the rule of virtue,capitalism and the political protest,which is the essence of Confucianism.The concept of rights in Pre-Qin is not only rich in connotations,but also has its own distinctive characteristics,which is manifested as the priority of goodness,duty and the righteousness.Compared with the Western society,rights in Pre-Qin expressed as the fundamental obligation and responsibility that the ruler must bear for the people,rather than expressing the individual's right to the government.The in-depth study is helpful to support support contemporary Chinese construction of theory and political practice.
