A Report On The Translation Of The Civil Judgment Husman V. Toyota

Research into legal translation in China is still in its fledging period and has a long way to go subject to social-cultural environment,language conventions,legal systems and other factors.Judgments,whose translation constitutes an important part of legal translation as a whole,epitomize right construction and interpretation of law,reasonable settlement of disputes,and popularization of law education within a country under the rule of law.Judgments of the U.S.courts,greatly different from Chinese ones,are characterized by clearly ascertained facts,accurate application of law and precise logical reasoning and argumentation,which is of great research value.The report concerns the process by which my translation of Husman v.Toyota,a civil judgment decided by the California Court of Appeal was completed.Based on the features of the ST and the difficulties in the ST and their underlying causes,the report,in the light of Li's three-dimensional translation concept-“Comprehension”,“Expression” and “Trade-off”,discusses and analyzes the concrete problems encountered during translation involving legal terms,legal citations,culture-bound expressions and passive sentences.Finally,strategies for solving these problems are proposed.Through the translation study on the ST,the author is expected to have her ability in legal translation improved and her knowledge enriched relative to common law and civil procedure in the United States.At the same time,it is hoped that the proposed strategies and approaches in the report will serve as references for future legal translation learners in solving specific problems encountered in legal translation and that my translation would make employment discrimination cases in the U.S.better known to the legal circles of China and thus help serve the purpose of improving Chinese laws and regulations.
