Research On The Independence Of Supervision In Tang Dynasty

Independence is one of the important principles to realize the efficiency of supervision.In the process of ancient China's supervisory history,rule by virtue--take advice,game between monarch and officials--the theory of supervising officials and the establishment of supervisory system are developing constantly,In this process,the emperor realized the lack of self-restraint of power,so he set up an independent supervision system based on the theory of "interest supervision,monarch's eyes and ears",and strengthened the supervision power to promote the independence of supervision,among which the Tang Dynasty's independent supervision system was the most representative.This article divides the independent supervisory system of Tang Dynasty into internal and external parts.On the external independent level,it establishes an independent supervisory organization system,guarantees an independent personnel management system and an external independent supervisory procedure,and forms an independent supervisory system with centralized power,independent status,unified organization and clear division of labor.In the aspect of internal independence,it establishes the internal independent system of supervision organization,objective internal management system,internal independent supervision procedure,and effectively separates the supervisory function power and administrative affairs power through the internal de-administration system setting,weakening the supervision internal administrative system's interference with supervisors.Through the joint efforts of internal and external systems,to a certain extent,to ensure the independent exercise of authority of the supervisory staff,to achieve the effectiveness of supervision.But the independent supervisory system in Tang Dynasty was based on the ancient supervisory idea,Because of the formation of feudal autocratic monarchy political system,there are deficiencies and loopholes in the system setup,and the defects of the feudal legal system model itself can not ensure the rationality and stability of the system.Therefore,the practice of the system is easy to be interfered by the internal and external supervision system to destroy the independence of the supervision,and then affect the effectiveness of the supervision.This article is mainly divided into five parts,the first part is the introduction,mainly introduced the article's writing background and significance,research methods and content;The second part is an overview of China's ancient supervisory independence and its theoretical basis,which mainly explains the development history of China's ancient supervisory system and its independence,analyzes the ideological basis of forming the supervisory system and its independence,and finally puts forward the division level of the system independence structure analysis in this paper.The third part is the system design of the supervisory independence of the Tang Dynasty.It mainly describes the independence idea and practice in the design of the supervisory independence of the Tang Dynasty,but points out the system variation in practice.The fourth part is the reflection of the supervisory independence in Tang Dynasty,which mainly expounds and analyzes the important factors that influence the supervisory independence.The fifth part is the conclusion part of this paper.
