Text Analysis And Optimization Path Of Regional Cultural Industry Intellectual Property Policy From The Perspective Of Policy Tools

With the acceleration of the national cultural industry development strategy,various regions are also arranged under the guidance of the central government to promote the development of creative economy.Under the rapid expansion of the industry,especially with the influx of IP boom,cultural products with "creativity" as the core have encountered many bottlenecks in the commercialized development process,arouse the concern of intellectual property in the industry.Intellectual property policy has gradually become a non-negligible part in the formulation of cultural industry policies in various regions.Based on the regional development characteristics of China's cultural industry,this paper selects the representative cities of North China,Beijing and the Yangtze River Delta cultural industry development representative city,Shanghai as the research object,and searches for the intellectual property policy in the cultural industry during the period of 2014-2018 as the samples.Through the policy tool and the "three-chain end" theory to construct a two-dimensional analysis framework,this paper quantitatively analysis the intellectual property policy content of the current cultural creative industries in the two places,summarizing the characteristics of various regional policies,and analyzing the value utility of current policies on all aspects of the cultural industry chain.At the same time,through the statistical analysis results of the intellectual property policy of cultural industries in Beijing and Shanghai in the two-dimensional analysis model,it is concluded that the current policy has the following problems.The macro characteristic of indirect policy tools has led to inadequate implementation.The single-repetition effect of the policy is not good.Among the current direct-type policy tools,IP capital investment policy tools,IP talent cultivation policy tools,government procurement policy tools and so on are seriously lacking,resulting in the current IP industry lacking direct resource replenishment.From the perspective of the industrial chain,policy tools lack of the cultivation of regional characteristics at the creative end,lack of updated iterations at the determination of right end,and lack of use of financial and taxation policy tools at the commercial end.Through the analysis of the limitations of the above policy tools,from the perspective of the national conditions,combined with the perspective of system theory,through the analysis and internal operation mechanism of external systems,this paper analyzes and summarizes the cooperative operation mechanism of intellectual property policies in regional cultural and creative industries.On this basis,combined with the practical problems existing in the empirical analysis of Beijing and Shanghai,the paper puts forward reasonable opinions for the formulation of the regional cultural industry intellectual property policy system.This paper believes that the regional cultural industry intellectual property policy should maintain the consistency of the macro policy system on the basis of excavating regional characteristics,that is,it should be consistent with the objectives of regional cultural industry policy and intellectual property policy.Based on the uneven distribution of policy tools in the policy system and the abuse of the policy tools,the proportion of environmental policy tools is appropriately reduced,and the proportion of direct policy instruments is promoted to promote the balanced development of policy tools within the industry.At the same time,in the policy formulation,we should learn from the actual experience of foreign countries to make up for the shortcomings in the current policy formulation.According to the law of the operation of the industrial chain system,it is necessary to strengthen the refinement of policies and enhance the guidance of policies on the actual implementation of industrial operations.Finally,it is necessary to make full use of the role of the feedback mechanism and achieve effective supervision of policy effects through effective feedback between subsystems.The innovation of this paper is that on the basis of summarizing the experience of predecessors,the introduction of policy instrument theory into the analysis of intellectual property policy of cultural industry,through the quantitative statistics of policies,it enhances the scientific nature of policy research.It also makes up for the shortcomings of “focusing on jurisprudence and ignoring management” in the research of intellectual property in the pre-culture industry.In the aspect of the proposal of policy optimization path,the system regulation theory is introduced,and from the perspective of the overall operation of the policy system,rationalization opinions are proposed for the regional cultural industry intellectual property policy.
