The Research On Consumers' Rights And Interests Protection Function Of Primary Department For Industry And Commerce

Everyone is a consumer,whose basic necessities in daily life are inseparable from consumption.Where there is consumption,there is dispute.The consumers need to protect their rights and interests.Safeguarding rights is closely linked with public interests of the masses.The administration for industry and commerce is a principal administration department for protection of consumers' rights and interests,one mainly task of which is to strive for a safer,more convenient,trustful,judgmatical,and more effective consumption environment.The writer was a grass-roots officer of department for industry and commerce and handled many cases regarding consumers' rights and interests.However,half cases were mediated unsuccessfully.Therefore,how to carry out the functions of primary departments for industry and commerce more effectively is an issue worth discussing and exploring.Provided that new public service theory were applied to the current consumer protection work,the status quo of both administrators' working methods and consumers' rights protection level would be improved at a certain extent.The paper made an anlysis of issues about executing the task to protect consumers' rights and interests by adopting new public service theory with an example of a primary department for industry and commerce in Shayang County,putting forward proposals to perfect function system of the department.The paper was completed in five chapters.Chapter one was the introduction;chapter two was to explain the department's functions through elaborating the concept of consumers' protection task and the content of this task's requirements at the primary department for industry and commerce.Then Chapter three was to analyze existing problems and challenges in the process of dealing with the matter on protecting consumers'rights and interests,including insufficient marketing supervision,deficient consumer rights efficiency construction,lacking mediating ability(especially grass-roots officers),disadvantageous consumption environment,and superficial understanding of the department for industry and commerce.Chapter four was to work out the problems existing in the department when performing their duties,which contained the problems of lagging thinking style,poor right-protecting mechanism,unprofessional training to the grass-roots officers,and of less efforts of social assistance and social publicity.And the last chapter was to raise suggestions on perfecting functional department from five aspects of changing regulatory philosophy and building a new pattern of supervision,of rationalizing right-protecting mechanism and improving its effectiveness,of intensifying training and enhancing staff's abilities,of establishing departmental cooperation and right-protecting mechanism of high efficiency,and of increasing public right-protecting sense by education.This paper mainly made a completed analysis of information and data collected based on research methods of theoretical study and case study taking Shayang Department for Industry and Commerce as the research target.It deeply explored how to improve right-protecting work at primary department so as to safeguard consumers' legal rights and interests and maintain social stability.
