Research On The Legal System Of The Green Finance

The author believes that Green Finance aims at promoting environmental and ecological protection and Green Finance is financial activities such as credit,industrial funds,securities,insurance,various types of financial derivatives transactions and related intermediary services etc.Now China faces Changing for model of development and adjusting economic structure,Green Finance will enhance economic vitality and promote the healthy & sustainable development for economy.Now Chinese Green Financial legal system is still in the initial stage,and China's Green Financial policies are made by the national ministries and regulations for the development of guidance,advice,notice and announcement etc.These Green Financial policy is not entirely a mandatory specification in the strict sense.These lead to great difficulties that Green Financial strategy carry out in China.Therefore,it is imminent to standardize and promote the implementation of green finance strategy.This paper summarizes the problems of the legal system for Green Finance fully and systematically in China,then finds out its shortcomings.On the basis of exploring the theory of Green Finance Promotion Legal System,this paper also analyzes the current situation of Green Finance in China and study foreign Green Finance Promotion Legal System.The author put forward some suggestions to perfect our Green Finance in our country.The whole article have three parts: Instruction,Text,Conclusion and Prospect.The text is divided as follows in details:The first part,theoretical overview.Firstly,interpret the meaning of Green Finance and clear Green Finance's substance.Secondly,the paper analyzes the historical evolution of Green Finance and points out that the development of Green Finance is a gradual process.Finally,the author reveal the theoretical basis of Green Finance from four angles : the theory of Externalities,financial enterprises' social responsibility,the social standard theory of economic law and sustainable development theory.The second part,on basis of combing for Green Finance Promotion Legal System at present situation,this article also summarizes the existing problems in Green Finance Promotion Legal System: First,the emphasis of green finance in our country is still not enough;Second,the system of Green Financial legal system is not complete;Third,It lacks of supporting specific system on Green Finance and the law of Green Finance.The third part,on the basis of studying Green Finance Promotion Legal System of United States,Germany and Japan,this paper sums up the successful experience of Green Finance Promotion Legal System and analyzes its Green Financial practices and system to our country.The fourth part,this part puts forward a series of countermeasures and suggestions for Green Finance Promotion Legal System.First,it suggests the legislative ways and legislative models of the Green Financial Promotion Legal System in our country.Then,it puts forward some superficial suggestions from four aspects including the legal system of emission rights,the legal system of green financial incentive,the legal system of green financial supervision and the legal system of green financial responsibility.
