Research On The Green Consumption Promotion Legislation

In recent years,the drawbacks brought by traditional consumption constantly remind that the development mode of high pollution and high energy consumption is no longer suitable for the needs of modern society.Green consumption is a new type of consumption pattern which pays attention to the fairness and harmonious development of resources within and between generations.It has attracted more and more attention because of its sustainable nature.With the constant promotion of green consumption,green consumption in China’s legal construction is still in the primary stage,The existing of green consumption laws and normative documents gradually revealed defects.That lead to accelerate the development of green consumption of thrust is not enough,the important reason is that green consumption to promote the legal system is not mature enough.It remains to be development.Through analysis,our green consumption to promote legislation mainly exist the following problems: first,from the legal system,laws and regulations about the green consumption in our country are scattered in some laws,regulations and other normative documents,not the basic law.It has not formed certain legal system,the lack of legal protection green consumption has been the lack of mandatory and binding;Second,from the implementation of the existing system,advocacy regulations play a dominant role.For example,consumers’ green consumption obligations are mostly advocacy regulations,which cannot effectively promote the practice of green consumption.Third,from the perspective of the applicability of green product standards and green procurement,the difficulties in the application of existing laws and regulations lead to the increasing distance between regional development;Fourth,from the regulatory system level,the existing defects make the supervision show the characteristics of fragmentation.Due to the complex administrative structure,the degree of environmental information disclosure is difficult to control and other issues,green consumption is facing a dynamic dilemma.In order to change the current development dilemma,first of all,it is necessary to improve the legal system of green consumption,construct the basic law of green consumption promotion,clarify the legislative principles of the green consumption promotion law and the rights and obligations of the subject,so as to provide certainty guidance for green consumption in the practice process.In addition,the optimization design in the green consumption law to improve the green,the applicability of the legal system,set up the green product certification system to reduce regional differences,perfect the green procurement supervision system,to restore the green financial and tax incentives,participated in the joint main body participation developing green consumption market,boosting the health development of green consumption.
