Problems And Countermeasures Of Grassroots Notarization Industry Development In China

After decades of development and transition,the notarization in China went through many historical stages and gradually formed the theoretical system with Chinese characteristics,which indicated that Chinese notarization industry was capable of playing an important role in avoiding legal disputes and solving contradictions.In addition,Chinese notarization industry adhered to its service conception of people oriented,which promoted the development of economy as well as the stability of society.During the third plenary session of the 18 th central committee,the Party claimed that “we ought to accelerate the classified reform of public institutions”,besides,the personnel department of Shandong province also issued “the Notification of Implementing the Classify of Public Institutions around our Province”.Therefore,Chinese notarization industry stands at the crossroads of the reform and development once again.Without explicit decision of using which development model,nowadays Chinese notarization industry models could be divided into administrative system,public institution system(which could be divided into two categories: enjoying full government funding and expense paid by their earning),cooperative system and the coexistence of various patterns.Nevertheless,we should attach more importance on how to choose notarization institution and how to design its development pattern,which concerns not only the developing program in the future,but establishing the functions of the whole grassroots judicial administration.There is no doubt that it involves thousands of notaries and the masses' s own benefits.In this paper,we took county-level city ZQ as an example,studied and discussed the industry development of the grassroots notary office,which was classed as the 3rd kind of public welfare during the reform process.Firstly,we analyzed the current situation of the notary office as well as the grassroots environment in ZQ.Secondly,combining data analyzing and comparison,based on the greater legal awareness of people and increasing demand of notarization on the present level of social economic development,we tried to dig out the problems of the notary office on every aspect in ZQ,and then discussed the reason in order to put forward relevant suggestions.And lastly but most significantly,by means of the active exploration of ZQ's notary office,we attempted to establish a pattern aimed at setting the developing direction for the grassroots notary industry,which would promote its development and meet the requirement at the present stage of grass-root society.As a matter of fact,the development of the grassroots notarization industry varies a lot in different grassroots conditions.Moreover,it's connected with some macroscopic and micro factors such as the local level of economic development,the size of the population,people's legal consciousness and so on.According to the method of this paper,we took ZQ's notary office for example,analyzed and studied the developing condition of such specific grassroots notarization institution,thereby deduced the developing pattern and direction of the entire grassroots notarization industry.Whether this research method is a good idea or not is subject to some debate along with the further development of the grassroots notarization industry.
