Study On The Institution Of Petition Work Of Local People’s Congress

The Chinese petition system is a democratic participation,power supervision and supplementary rights relief system with Chinese characteristics.With the profound changes in China’s economic system,social structure and the transformation of benefits pattern and ideology,a large number of contradiction and social problems are reflected through the channels of Letters and Visits.As organ of state’s power,the local people’s Congress Standing Committee is the safeguard of the fundamental interests of the people,and also the highest form and an important way for the people to be the master of the country.Therefore,compared with other Letters and Visits Bureaus,the petition work of the people’s Congress is unique.However,in reality,the People’s Congress has become a second tier sector,its status and role is weakening.The People’s Congress supervision power can hardly be fulfilled.The function of petition work of People’s Congress can only stay on the surface.The causes of this situation are not only institutional,but also the own limitation of the people’s Congress.In view of this,focusing on the operation mechanism of Local People’s Congress petition system,taking People’s Congress and its Standing Committee petition work of Haicang District in Xiamen City as an example,based on the legal analysis and development process of People’s Congress petition system,this paper analyzes the present situation,problems and causes analysis for the Local People’s Congress petition.At the same time,in order to improve the National People’s Congress petition work,explore the effective way to link the People’s Congress supervision power and petition work,this paper designs to establish the centralized pattern of people’s Congress petition system,so as to further enhance the People’s Congress position,bring the People’s Congress petition work to a new level.The full text is divided into six parts.The first part is "introduction",which illustrates the research background and significance,research status,research content and methods.The second part is "general theory and development process of the People’s Congress petition system",which reviews the legal and theoretical basis of the People’s Congress petition system.The third part is "local People’s Congress petition system configuration and operation mechanism",which analyzes the positioning,organizational structure,characteristics and operation mechanism of People’s Congress petition system.The fourth part is "Status quo of Local People’s Congress petition work——take Haicang District in Xiamen city as an example",which elaborates the status quo of People’s Congress petition work of Haicang District,its process mode and sums up the problems faced by the current system of People’s Congress petition system and the deep-seated reasons for the problems.The fifth part is "Case study——take People’s Congress petition work of Haicang District in Xiamen city as an example",which elaborates the case selection reasons,analyzes one specific case and related reform and innovation.The sixth part is"reform and improvement of the People’s Congress petition system",which proposes three aspects of assumptions and suggestions:improving the legal system and working system,exploiting the advantages of the delegates and establishing the centralized pattern of people’s Congress petition system.
