Study On The Problems And Countermeasures Of Petition In Huangpu District Of Shanghai

Petition system is a characterized system of China, which is produced by our socialist construction. The petition, refers to the citizens, legal persons or other organizations reflecting the situation,Putting forward their suggestion,proposing,complaints and demands to all the levels of people’s government or it’s departments that above the county level, which can take the relevant legitimate activities by the law.The petition as a kind of legitimate right owned by Chinese citizens is also an important channel, that can guarantee their participating in the country management, economic construction,social issues and maintain for other kinds of their legitimate rights. With the high speed development of city and the changed structure of the social economy Since the reform and opening up to outside world of China, the gap is wider and wider between the rich and poor, the contradiction becomes more and more serious between the various social strata, which makes petition contradiction become one of the most important factors leading to the stability of the whole society, also the petition system itself faces more serious situation than ever known. Our country formed the first "petition regulations" in 1995 October, which standardized petition process for all the levels of the government. It meant that petition system began it’s very new time in China. According to the continuous change of the current petition situation, our country adjusted the petition pattern and formed a new "petition regulations" to strengthen and improve its legal system in 2005 January, and which had achieved very remarkable results. Although the "petition regulations" is the highest level of petition legal fields at present, in practically it is only an administrative regulation that also contains the unreasonable problems during its process of operation. Because of the author working at the petition office of Huangpu government in Shanghai, that is the most basic department of coordinating the masses disputes, she has more chances to contact on all kinds of petition contradictions, also has deep reflection for these petition problems, so she explores the idea to discuss them by her position advantage. She also can collects more detailed of petition situation through certain channels to improve the petition insufficient,which would produce very significant value to the petition work of Huangpu District. Therefore, this thesis mainly takes the petition of Huangpu District as an example, proposing the corresponding suggestion and the countermeasure that combine with some advantage of foreign "petition mode ", which can promote the better development of petition work in Huangpu District.
