Research On Registration Question Of Rural Collective Forest Land Rights In China

In promoting the development of forestry in China,comprehensively promote the collective forest reform,clear contracting relationship,demarcation certification,clear property rights is the main task of reform.Forest registration is one of the most important part of the government is the implementation of the premise of administration.Forest land rights registration can better identify the dominant position of forest land contract and management rights of the people,protect the legitimate rights and interests of operators;the same time,also help to identify the forest resources of the quantity,quality,and overall distribution,the Government will facilitate to China Of the forest resources of the cutting configuration for macro-control and micro-regulation.Although the forest rights system in China has been reformed several times,the management of forest rights registration is still not enough attention,so that every year a large area of forest land is requisitioned and illegally occupied(according to the data of China Forestry Network,6178.9 hectares),resulting in the massive loss of forest resources in China,while also increasing the pressure on forestry management.Access to relevant laws and regulations of our country,involving the registration of the legal provisions of forest rights scattered,the lack of systematic,independent,targeted,so far there is no special forest land contract la,w,forest land contract is based on land contract law to carry out work.Although in the specific practice can be completed through the integration of different legal provisions of the registration work to achieve a temporary ideal state,but still exposed some obvious problems,such as registration and certification procedures are not standardized,the quality of registration and certification work is not high and so on.In order to solve the problems existing in the registration work,we should revise the relevant laws,strengthen the independence and pertinence of the legislation of forest land registration,establish the basic principles and ensure that the work can be carried out,such as strengthening forest land contract legislation,Circulation legislation,forest registration legislation,improve the forest file management system,to ensure that woodland,forest ownership is clear,from the system to protect the legitimate rights and interests of people,to stimulate their love forest,forest protection,the development of forestry initiative.This paper analyzes the causes of the problems from the different thinking paradigms between the peasants' logical points and the starting point of the national policy,and then puts forward the solution to the problem from the consciousness,system and technology.
