Study On Legal Countermeasures Of China's Dual Nationality

Nationality is a person to enjoy the civil rights as a country's citizenship,China's current nationality law is the "Nationality Law of People's Republic of China "published in 1980.After 30 years of development,the original single nationality policy is not suitable for the development of the times.At present,China has formed a large number of de facto dual nationality.Every year a large number of talents and financial loss,overseas Chinese strongly called for the establishment of dual nationality system.For these kinds of reality,whether we should admit that dual nationality sparked a heated debate,each one has its firm point.Whether should we recognize the dual nationality,if we want,how to implement it.I have done this in-depth study.This paper mainly elaborates the research on dual nationality from the following aspects.The first part describes the concept of nationality:the concept of nationality,the classification of nationality,the meaning of nationality,the acquisition of nationality and so on.The second part reviews the historical evolution of our nationality system in detail,from the birth of the First Nationality Law "Qing Nationality Regulations" to the"Nationality Law of the People's Republic of China".So far,China has promulgated four nationality laws.This article analyzes the historical background and its far-reaching influence of each nationality law.The third part describes the formation and causes of the de facto dual nationality after China's reform and opening up.The fourth part is the inventory of our country on whether to recognize the dual nationality,supporters and opponents of their respective positions.The fifth part is the combination of China's national conditions and historical experience and foreign enlightenment to put forward their own points of view that China should recognize the dual nationality of the idea.The last part is the road of gradual recognition of our own dual nationality with my own suggestions and ideas.This paper adopts the methods of historical analysis,case analysis and method analysis to study the current nationality system in our country.After summarizing all aspects,this paper draws the conclusion that China should recognize double nationality.On the issue of recognition of dual nationality,we oppose the fact that the researchers treated this problem with "all or no" attitude,mainly to reduce the existing green card threshold in our country and establish a double nationality system with Chinese characteristics.
