Research On The System Of Civil Remedies For Infringement Of Network Privacy

Due to the rapid development of science and technology,the popularity of the network in the global scope of the increasingly high rate,people in their daily work and life depend on the network more and more strong,however,network privacy violation situation more severe.The legitimate rights and interests of the infringement of the right to privacy not only damages,but also increase the public's sense of insecurity,hindered the development of the information industry,to strengthen the protection of privacy on the Internet is the inevitable requirement of social development.There is an old saying:"no relief,no right",this sentence tells us,regardless of protection provisions of the law on civil rights and how complete,if these rights are violated,citizens can not get effective relief,so these legal rights is a mere scrap of paper,no practical significance.In order to better protect the network privacy,improve the relief system is a priority.In this paper,the right to privacy of the network as the research object,the integrated use of case analysis,literature research method,comparative analysis method and other research methods,to discuss the current situation and protection of the right of status of the European Union and the United States network privacy relief in China,and to seek our country how to improve the network privacy right infringement civil relief system.This paper is divided into four parts.The first part is an overview of Internet privacy reasons,forms,characteristics,infringement analysis on connotation of China's network privacy and network rights;the second part,China's network privacy infringement analysis on the current situation of civil relief,legislative status,theory system,social situation and judicial situation of the civil remedies are discussed;the third part mainly to the EU and the US internet privacy protection status of the comparative study,put forward the advanced experience for our reference;the fourth part,in view of China's Internet privacy infringement and civil relief situation,combined with the experience of the European Union and the United States,from the clear protection mode of Internet privacy in our country,improve China's civil remedy and the establishment of civil relief social responsibility system in three aspects are discussed.
