| The internet technology has been always a double sword. While the internet has providedpeople a fast and convenient way to communicate, it also bring some drawbacks. In a word,the protection of privacy under the Network environment is one of the problems to be solved.With the introduction of the tort liability of the People’s Republic of China, it changes the nolegal basis for the state before. But, due to the relevant provisions of the law on internetprivacy is overly broad, is not specifically elaborate on the privacy in the networkenvironment. The author intent to introduce the problem of privacy protection by the form ofcase. In addition, the author also use foreign doctrines and practices to explore the legalsystem construction of China’s Internet Privacy Protection to make some reasonablesuggestions.The paper consists of three parts:The first part is the case of the study. This part by introducing a representative case,which called “the first case of the human powered search” in recent year to raise the questionabout internet privacy protection.The second part is about the controversial points and differences in focus. This sectionwill focus of controversy in the cases listed, proposed to solve the main problem.The third part is a survey of Civil Protection of Internet Privacy. This section is dividedinto the following four levels to explore: The first level defined from a theoretical point ofview on internet privacy, including the meaning of internet privacy, specific content andfeatures. The second level is about to compare the status quo of foreign internet privacy. Thethird level is the introduction of internet privacy-related system and the status quo in China.The fourth level is the idea to set up the framework of the civil law protection for internetprivacy right in China.The fourth part is conclusion. This section is a summary of the article, not only make arecognized legal relationship involved, but also summarize the commitment of responsibility. |
