Although China has made great economic achievements and is already the world's second largest economy,but China's economic unit GDP energy consumption is relatively high,the economic green component is low.The inefficient use of resources not only brings huge economic waste but also makes the ecological environment of our country continue to deteriorate.It is estimated that China's annual economic losses caused by environmental pollution account for about 10%of the gross national product.In such a severe environmental situation,green credit as the country through credit funds to guide the financial means to guide the bank funds to invest in green low-carbon industry,exit high energy efficiency,high pollution industry,its role in the protection of China's ecological environment is critical.Commercial banks want to effectively carry out green credit can not be separated from a good legal environment.However,China's early introduction of laws and regulations have been unable to adapt to the current rapid economic development of the current situation;and the recent introduction of a small amount of legal norms seem too principled,not operational;a large number of policy guidelines are only stay in the encouragement level and no To enforce the law.The lack of legal environment of green credit brings all kinds of uncertainties,so the commercial banks in China under the market economy conditions,the risk of conscious implementation of the willingness to carry out low,so the healthy development of green credit must be provided by legal means to protect.In foreign countries,green credit,green economy concept has been known,many developed countries have a more mature green credit laws and regulations,and in our country is almost blank.To this end,China's green credit-related laws to improve it is particularly necessary.This paper used comparative research and case analysis,and the article is divided into seven parts.The first part explains the concept of sustainable development and green credit.The second part introduces the basis of the green credit,the equatorial principle.The third part analyzes the green credit legal risk.The fourth part analyzes the legal problems of green credit in China.The fifth part introduces the experience and legislative experience of practicing green credit both at home and abroad.The sixth part of the article combined with China's national conditions,China's green credit legal path to explore.The seventh part is a summary of the full text.
