Legal profession aims at providing relief against right defects and promoting realization of rational order in society,while its professional specificity determines that it is characterized by ethic morality.The legitimacy of lawyers' practice is based on the specific professional ethics,ethic values,ethic relation and ethic evaluation.Lawyers have not obtained social trust and recognition of society so far;but conversely the public expresses dissatisfaction and resent against lawyers' “prerogative”.The so-called “prerogative” is the currently worshiped “principle of partisanship”,distorting the original goal of legal professional ethics.Especially under the regularization constructing approach of China nowadays,the neglect of ethic character has shaped legal professional ethics into an objective and neutral regularization mode,causing lawyer ethics to deviate further and further from public morals.Hence,attention should be given to lawyers' ability of practical reason so as to modify the deviating ethic rules in constant reflections,including standard conception of lawyers' role,resistance against role morality overrunning common morality.Under the condition of possessing the correct cognition,a set of professional ethic rules can be proposed to modify,uplift,and moralize lawyer human structure.Among them,defending conscience is the moral ethic baseline for lawyers,practicing justice is the ultimate responsibility,retaining independence is the fundamental nature of profession,and undertaking social responsibility is the mission of the times.The realization of regularized legal professional ethics mainly relies on internalizing moral rules as lawyer individual virtue for self discipline,and a series of supporting guarantee systems should be put in place to supervise lawyers in fulfilling their duties.
