Research On Punishment Mechanism Of Community-based Correction Personnel's "Intermediate Behaviour" In China

Community corrections are corrections against non-custodial sentences imposed by criminals sentenced to probation,parole,control,temporary execution outside prison,and deprivation of political rights.Through the help of the government,society,and others,they correct their bad habits.Return to society smoothly.The community correction system is a system that conforms to the trend of social development.It is produced under the background of socialization of execution.Compared with traditional pure punishment and retribution,community correction effectively avoids this problem of cross-infection.Secondly,the most obvious effect is that people who have been sentenced to control,probation,parole,and temporary execution outside the prison are placed in the community to be corrected by the community,which alleviates the tension in the prison and the staff's excess.Control the size of the prison population,thereby improving the quality of criminal education reform criminals,while also saving judicial resources,saving the country's execution resources.Community correction adopts community help education to help it successfully return to society and complete personal transformation.It is a major breakthrough in the concept of human punishment.The development of community correction plays an important role in the development of the penalty theory in our country.At present,many countries in the world have relatively mature measures for community corrections.The more developed countries are the United States,Britain,Canada and other Western countries.Due to the late development of China's community correction system and the relatively complex social environment,the foundation of community correction and development is not solid.Therefore,community correction faces many problems in the development of our country.The most profound problem is the correction of community corrections.The “intermediate behavior” disciplinary mechanism is not mature enough to prevent the rectified persons from committing further crimes.Therefore,the present background is based on the current development of social corrections in the country.It addresses the problems existing in China's current community correction and combines the mature community correction systems in many western countries.Based on the background of our country's society,we must take its essence to its dross and establish a mature community correction system that is suitable for China.Specifically,the content of this article first introduces the concept of community correction system and the current situation of community corrections in China.It then proposes that the current problems in the community correction system are mainly due to the imperfect disciplinary mechanism of “intermediary behavior” in correctional personnel.Learning from Western countries such as the United States,Britain,and Canada,community correction systems,such as "the progressive treatment system","grading management system" and community correction orders and other forms.Through the reference of the community correction system in Western countries,we propose corresponding solutions to the current development of community corrections in China.Looking at the current domestic research on community corrections,the focus is still more on community correction as a substitute for penalties.What benefits do they have for the development of China's penalty system and what are its development prospects? During the course of community corrections,what problems have arisen and what are we lacking in comparison with the Western developed countries such as the United Kingdom and the United States? However,the current domestic discussion of these issues still remains in the community correction system itself,and does not take into account the effect of community correction system practice.Therefore,there are few people currently discussing how to regulate,and there is a relatively lack of research on the disciplinary mechanism of correctional personnel,and the related research on the disciplinary mechanism is still a relatively cold field.Therefore,it is necessary to conduct in-depth research and study on this issue.
