Analysis On The Legislation Of Higher Education System In Our Country

The university is set up by the government according to the education law of the People's Republic of China,the higher education law of the People's Republic of China and other relevant laws and regulations,aims at developing higher education and cultivating talents for the country and society.Under the background of ruling the country and administering the education according to the law,running the school by law has become the goal of the development of university.In recent years,universities have been involved in lawsuit cases frequently,on the one hand,it shows that along with the advance of China's social progress and the citizen's legal consciousness strengthened gradually,the society begin to perform obligations and rights in accordance with the rules of law.On the other hand,it also exposes that there are many problems in the course of exercising the administrative authority,for example,lacking of procedural procedures of the normative,and also lacking of specific implementation steps on some forms and substantive elements.In particular,the behavior of the subject of administrative right is the most serious problem.Therefore,under the background of the construction of the rule of law and the rule of law in our country,it has practical significance to study the legislative aspects of the subject of the management right of universities to regulate the proper exercise of administrative authority and safeguard the legal rights of teachers and students.From the perspective of management subject in university,this paper analyzes the legislative problems of higher education system in China,and analyses the legislative status of the main body of university management in China from four aspects,on the legal nature and legal status of the university,such as the management nature of the subject,the duty and responsibility of the university,the procedural stipulation of the university management as well as the supervision of the management behavior,and we also finds out the problems in the legislation of the subject of the management right in the universities,finds out the causes of the problems,and tries to find the way to improve the legislation of the main body of theadministration in universities.In order to manage the future,the universities can reasonably exercise management authority,follow due process,fulfill their obligations and take responsibility,and create a good environment for the development of higher education in our country.
