On The Legislative Improvement Of The Management Mode Of Nature Reserves In China

Nature reserve is of great significance for our country' s ecological security,and it is also an important form of protection for the diversity of classical ecosystem and species.With the number and size of the nature reserve increasing,the problems of the management and protection of nature reserve are also increasing,such as the lack of the fund and manager,the transformation of the management goals and the difficult coordination of the management organization's contradiction.How to ensure the sustainability of the management and protection of the nature reserve is a problem urgently to be resolved.Nature reserve legislation is a legal basis for the construction and management of normative nature reserve,so the degree of its perfect is of great significance for the sustainability and management of nature reserve.According to our country's present problems existing in the nature reserve management,this article use the manner of literature analysis and empirical analysis,analyzes the limitations of the administration mode of nature reserve,and introduces the operating experience of the National Trust administration mode in nature reserve and enlightenment for our country so as to try to build our country's management model of trust in the legislation of nature reserve and lern from relevant experiences to improve the administration mode in our country's nature reserve.This article contains three chapters.The first chapter combs the actual state of legislation in the nature reserve management model,analysis the characteristics,the existing management mode of nature reserve in China.Combined with the existing legal system in our country,we summarize the problems existing in the management process of nature reserve protection.By analyzing the relevant specific case,we think specificity of the management goals and the limitations of the administration mode are the reasons for the difficult management problems in nature reserve.The limitations of administration mode embody in two aspects:management mechanism and management goals(the management objective;the limitations of funds safeguard mechanism,coordination mechanism and supervisory mechanism).The second chapter defines the relevant concepts of the nature reserve and national trust and introduces the snapshot of national trust management model in the nature reserve(including legislative situation,connotation,concrete operation and effect),and analyzes the superiority of national trust management model in the nature reserve.The necessity to bring it into our country:Combining trust and nature reserve protection management system is beneficial to realize the diversified sources and make up for the shortage of funds management problems;Scientific trust management organization setup is beneficial to introduce professional technical and personnel;Trust science system operation mode is beneficial to promote people to participate in the protection of nature reserves and coordinate conflicts of different interests,which can effectively make up for the inadequacy of the existing management mode in our country's nature reserve,to ensure the implementation of goals of the nature reserve management.At the same time,the author give full consideration to the special national conditions("state ownership"),and make the analysis of the feasibility of introducing the national trust management model.The third chapter is about the perfection of the legislation of nature reserve management mode in China,which is the construction of nature reserve management of the trust management model in our country:first,based on the textual research of the present legislative ideological basis and legislative practice,put forward concrete suggestions for how to design the corresponding clause of the national trust management model.In addition,we set the application conditions and application process.Third,combined with the actual,we set the specific management main body and the administrative authority of the trust management model in China nature reserve.Last but not the least,we establish a set of completed legal system of national trust management model,including the system of principal qualification censorship,the trustee candidate system and the system of judicial supervision.
