| Bitcoin is a new thing that has been active in the currency sector since its appearance in 2008.It is born in demand at the time.The value and utility embodied in Bitcoin has been gradually recognized by people,and its field of application has also been continuously broadened and popular with people,especially the series of advantages(such as anonymity,borderlessness,etc.)brought about by its "decentralization" feature.However,this feature also brought a series of problems such as violent price fluctuations,money laundering,or the impact of national legal currency and monetary policy.In response to Bitcoin's risk,China chose to limit the contact between Bitcoin and the banking industry so as to avoid the transmission of risks.The countries of the world have shown different attitudes when faced with Bitcoin issues,such as regulating the operation of Bitcoin in tax laws,consumer protection,mediation,industry self-discipline,and case law.At present,research on Bitcoin in China's academic circles has basically focused on the nature of Bitcoin and its financial implications.However,legal issues arising from Bitcoin have not been adequately studied and systematically studied.For the legal supervision of Bitcoin,there are mostly theoretical speculators and the operability is not strong.However,Bitcoin has negative impacts and risks on individuals,countries,and regulations.The impact on the country is reflected in: the central bank and monetary policy;taxation work is more arduous;increase the difficulty of punishing financial crime.The impact of the regulatory system is reflected in: the difficulty of applying the evidence law;the fuzzification of the jurisdiction;the difficulty of securing the evidence.Therefore,it is imminent to construct the lawful supervision system of Bitcoin.China should improve the relevant legislative system and the judicial regulation system of Bitcoin as soon as possible,and strengthen the mechanism of market risk prevention and control and regulatory regime.On this basis,a Bitcoin legal supervision system with Chinese characteristics has been established so as to address the problems caused by Bitcoin to some extent. |
